Smietanka v. First Trust & Savings Bank.-Supreme Court of the United States (42 Sup. Ct. Rep. 223; T. D. 3321). Income held and accumulated by a trustee for the benefit of unborn or unascertained beneficiaries is not subject to the income tax imposed by the revenue act of 1913, although such income is expressly subjected to tax under all later income-tax acts. Under the provisions of the revenue act of 1913 a trust estate is not taxable as an entity. The act requires the fiduciary to withhold and pay the normal tax upon the income of the estate or trust property distributed, but the trustee is not liable for the surtax which is payable by the beneficiary
